End User License Agreement & Terms of Service

This agreement is between you and SketchCAD LLC ("SketchCAD", "we", "us") and governs your use of the SketchCAD service at sketchcad.co. By using the service you accept these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the service for your own business or personal drafting work, subject to these terms. This is a licence to use a hosted service; no copy of any software is sold or transferred to you.

2. Your drawings and your output — you own them

You keep all rights in the drawings you upload and in the CAD files SketchCAD produces from them. We claim no ownership over either, and the converted file is yours to use commercially, edit, share or resell as part of your work, with no attribution required.

You grant us only the narrow licence we need to run the service: to store, process, convert and transmit your files so we can return the result to you, and to keep them available for download until you ask us to delete them. Nothing more.

3. What you must not upload

• Drawings you do not own or otherwise have the right to convert.
• Anything unlawful, or material that infringes someone else's rights.
• Malware, or files designed to disrupt the service.

You must not attempt to break, overload, scrape or reverse-engineer the service, or resell access to it as your own conversion product.

5. Credits, payment and refunds

Converting and previewing a drawing is free. Exporting a finished file uses an export credit, sold in packs through Stripe at the prices shown at checkout. Credits are applied to the browser you bought them in when payment clears and do not expire.

If an export fails through a fault of ours, tell us and we will restore the credit or refund it. Beyond that, credits are non-refundable once spent, since the conversion work has already been performed.

6. Availability

We aim to keep the service running but do not guarantee uninterrupted availability. It depends on third-party infrastructure (see the Privacy Policy) and may be interrupted for maintenance, provider outages or changes. We may modify or discontinue features.

7. Your credits

There are no accounts. Credits are held against an identifier your browser generates and keeps in its own storage, so they belong to that browser: clearing its storage, or moving to another device, leaves them behind. If that happens, email us with your Stripe receipt and we will restore them.

8. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the converted output will be accurate, complete or fit for construction use.

9. Limitation of liability

To the fullest extent permitted by law, SketchCAD is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data, construction costs, rework or project delays arising from use of the service or reliance on converted drawings. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded.

10. Indemnity

You agree to indemnify SketchCAD against claims arising from drawings you uploaded without the right to do so, or from your breach of these terms.

11. Termination

You may stop using the service and ask us to delete your data at any time. We may suspend or terminate access if these terms are breached. Sections 2, 4, 8, 9 and 10 survive termination.

12. Changes to these terms

We may update these terms; the date at the top will change and continued use after an update means you accept it.

13. Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and SketchCAD LLC agree that the exclusive venue for any dispute arising out of these terms or the service is the state and federal courts located in Dallas County, Texas, and each of us consents to the personal jurisdiction of those courts.

If any provision of these terms is held unenforceable, the rest remains in force.
